1. Identity of the merchant

These Terms and Conditions apply to all offers, orders and agreements concluded via the webshop ShinraiKnives.

ShinraiKnives is a trade name of:

2. Definitions

In these Terms and Conditions, the following definitions apply:

  • Merchant: Divance Webshops B.V., operating under the trade name ShinraiKnives

  • Consumer: any natural person acting for purposes outside their trade, business or profession

  • Agreement: the distance contract concluded between Merchant and Consumer

  • Product: all goods offered by ShinraiKnives

  • Website: www.shinraiknives.com

  • Withdrawal: the Consumer’s statutory right to withdraw from the Agreement


3. Applicability

3.1 These Terms and Conditions apply to every offer made by ShinraiKnives and to every Agreement concluded between ShinraiKnives and a Consumer.

3.2 Before the Agreement is concluded, the text of these Terms and Conditions is made available electronically in a manner that allows the Consumer to store and reproduce them.

3.3 By placing an order, the Consumer declares to have taken note of and agreed to these Terms and Conditions.

3.4 Deviations from these Terms and Conditions are only valid if expressly agreed upon in writing.

3.5 These Terms and Conditions apply exclusively to consumer transactions. For business customers, separate terms may apply.


4. Offers and product information

4.1 All offers on the Website are without obligation and subject to availability.

4.2 Product descriptions, specifications, images and prices are compiled with due care. Minor deviations, typographical errors or non-material inaccuracies do not entitle the Consumer to compensation or termination of the Agreement.

4.3 If a Product is offered as a pre-order, this will be clearly indicated on the product page, including an estimated delivery timeframe.


5. Contract formation

5.1 The Agreement is concluded at the moment the Consumer completes the order process and receives an order confirmation by e-mail.

5.2 ShinraiKnives reserves the right to refuse or cancel an order if there are reasonable grounds, including but not limited to suspected fraud, incorrect pricing, payment issues or stock discrepancies.


6. Prices, taxes and payment

6.1 All prices stated on the Website are inclusive of VAT, unless stated otherwise, and exclusive of shipping costs.

6.2 Payment must be made in full prior to shipment using one of the available payment methods, including but not limited to:
iDEAL, Credit Card, Apple Pay, Klarna (Pay Later / Pay in 3), Bancontact, American Express, Blik, Przelewy24 and PayPal.

6.3 When Klarna is selected, Klarna’s additional terms and conditions apply. ShinraiKnives is not responsible for Klarna’s approval or payment decisions.


7. Delivery and shipping

7.1 Orders are shipped from the Netherlands.

7.2 Indicative delivery times:

  • The Netherlands: 1-2 business days

  • International deliveries: delivery times vary depending on destination

7.3 Delivery times are indicative and do not constitute a strict deadline. Exceeding an estimated delivery time does not automatically entitle the Consumer to compensation or termination of the Agreement.

7.4 Delivery is deemed to have taken place when the Product has come into the physical possession of the Consumer or a third party designated by the Consumer.

7.5 The Consumer is responsible for providing a correct and complete delivery address. Additional costs resulting from incorrect address details, refused deliveries or returned-to-sender shipments may be charged to the Consumer.

7.6 For international shipments, ShinraiKnives is responsible for any import duties, customs charges or local taxes imposed by authorities in the destination country.


8. Right of withdrawal (30 days)

8.1 The Consumer has the right to withdraw from the Agreement within 30 days without giving any reason.

8.2 The withdrawal period expires 30 days after the day on which the Consumer, or a third party designated by the Consumer, receives the Product.

8.3 To exercise the right of withdrawal, the Consumer must notify ShinraiKnives by e-mail (hello@shinraiknives.com) with an unequivocal statement.

8.4 The Consumer may use the model withdrawal form included in Annex 1, but this is not obligatory.


9. Consequences of withdrawal

9.1 After withdrawal, the Consumer must return the Product without undue delay and in any event no later than 14 days after notifying withdrawal.

9.2 Upon withdrawal, ShinraiKnives shall reimburse all payments received from the Consumer, including the costs of standard delivery (if applicable), without undue delay and in any event no later than 14 days after being informed of the withdrawal.

9.3 ShinraiKnives may withhold reimbursement until it has received the returned Product or until the Consumer has provided proof of return shipment, whichever occurs first.

9.4 Reimbursement will be made using the same payment method as the original transaction, unless expressly agreed otherwise.

9.5 The direct costs of returning the Product are borne by the Consumer, unless:

  • the Product is defective;

  • the Product was damaged upon receipt; or

  • ShinraiKnives has approved an exchange,
    in which case ShinraiKnives will cover the return costs.

9.6 Returned Products must be unused, undamaged and packaged appropriately. The Consumer is only liable for diminished value resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the Product.


10. Exclusions from the right of withdrawal

The right of withdrawal does not apply to Products that:

  • are custom-made or clearly personalized;

  • show clear signs of use beyond normal inspection.


11. Warranty and conformity

11.1 All Products comply with the Agreement, the specifications stated in the offer and reasonable expectations of quality and usability in accordance with EU consumer law.

11.2 ShinraiKnives provides a 7-year commercial warranty on its Products, in addition to the Consumer’s statutory rights.

11.3 The commercial warranty covers material and manufacturing defects under normal household use.

11.4 The warranty does not cover damage resulting from misuse, improper maintenance, unauthorized sharpening, accidents, corrosion due to neglect, or normal wear and tear.

11.5 In the event of a valid warranty claim, ShinraiKnives may, at its discretion, repair the Product, replace it with an equivalent product, or provide a partial or full refund.

11.6 Warranty claims must be submitted via hello@shinraiknives.com, including proof of purchase, pictures and a description of the defect.


12. Use of products and safety

12.1 Products sold by ShinraiKnives are intended for normal household use unless explicitly stated otherwise.

12.2 Knives are sharp instruments. The Consumer is responsible for safe handling, storage and use.

12.3 ShinraiKnives is not liable for injuries or damage resulting from improper, careless or unsafe use of the Products.


13. Liability

13.1 ShinraiKnives liability is limited to the extent permitted by mandatory law.

13.2 ShinraiKnives is not liable for indirect or consequential damages, including but not limited to loss of profit or loss of use, except where such limitation is not permitted by law.

13.3 Nothing in these Terms and Conditions excludes or limits liability for intent, gross negligence or statutory consumer rights.


14. Force majeure

ShinraiKnives is not obliged to fulfil any obligation if prevented from doing so due to force majeure, including but not limited to natural disasters, strikes, pandemics, transport disruptions or government measures.


15. Complaints and dispute resolution

15.1 Complaints must be submitted within a reasonable time after discovery via hello@shinraiknives.com.

15.2 ShinraiKnives will respond to complaints within 14 days.

15.3 Where applicable, Consumers may seek assistance from a competent alternative dispute resolution (ADR) body or their local consumer protection authority. ShinraiKnives is not obliged to participate in ADR unless required by mandatory law.


16. Governing law and jurisdiction

All Agreements are governed by the laws of the Netherlands.

Disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.


17. Amendments

ShinraiKnives reserves the right to amend these Terms and Conditions. The most recent version is always available on the Website.
